TERMS & CONDITIONS
TERMS AND CONDITIONS AGREEMENT:
For the purpose of this Rental Agreement, “South Party Rentals” shall mean Rental Company, its, and Employees; “Customer” shall mean Customer, Customer’s Guest/Visitors, its Agents and/or Employees. In consideration of the hiring of the rental item(s)/equipment described in the agreed upon invoice or estimate for this Rental Agreement, it is agreed as follows:
CUSTOMER PICK-UP/RETURN. Responsibility of rental item(s)/equipment remains with Customer from the time loaded until the time returned. Loading, unloading, and securing the rental item(s)/equipment is the Customer’s sole responsibility. South Party Rental will not be held liable for any accidents or any type of damage done to any vehicle or rental item(s)/equipment due to improper loading/unloading.
LATE CHARGES. Applied at a daily rate if item(s)/equipment are not returned by the return date indicated in Rental Agreement.
RECEIPT/INSPECTION OF RENTAL ITEM(S)/EQUIPMENT. Item(s)/equipment are checked prior to release. Customer should inspect all item(s)/equipment before an event. Customer further acknowledges receipt of all rental item(s)/equipment listed on this Rental Agreement and that the rental item(s)/equipment are in good working order. If item(s)/equipment is not found to be in working order, South Party Rentals must be notified immediately for an exchange/refund. No refund will be given due to defect/failure if Customer does not give ample notice prior to the event. Do not attempt to repair/disassemble item(s)/equipment. Charges will apply for broken/altered item(s)/equipment. Customer are aware that the rental equipment are not brand new.
RESERVATION TERMS: All reservations must be secured with a deposit of either cash, or credit card totaling 50% of the total rental. Customer agrees to pay rental charge when due. Plus fill out Credit Card Authorization form for security of the rental items while out. Any cancellations of reservations less than one week prior to the reservation date will forfeit any deposit. *If deposit is not received, your order will remain a quote, not a reservation.
CATERING/SERVING ITEM(S)/LINENS/EQUIPMENT. All food-related item(s)/equipment must be returned CLEAN and RINSED FREE OF FOOD. SHAKE FREE FOOD/DEBRIS FROM TABLECLOTHS
REFUND POLICY. Each rental is for time out regardless if the item(s)/equipment were used or not. If item(s)/equipment is not found to be in working order, South Party Rentals must be notified immediately for an exchange/refund. Otherwise Client will be charge for damage. Refunds on Debit / Credit card will incur a transaction fee.
Cancellation Policy: Reservation must be cancelled at least 4 week before delivery to avoid the following charges: Cancellation within 4 week will incur a 25% - 50% restocking fee. Cancellation after the truck is loaded will incur a 75% restocking fee. Cancellation after the truck has left the warehouse will incur a 100% restocking charge- Forfeit full deposit. Cancellation for special orders that requires purchase products in advance 65% + fee.
MISSING OR DAMAGED ITEMS:
Items not returned within 2 days after event are considered missing. Missing or damaged items will be charged to the credit card / security deposit at replacement cost. A detailed invoice of these items will be provided to client.
All collection fees, attorney fees, court costs, or any expense involved in the collections of rental charges will be the client’s responsibility.
Please note when placing a tent rental – Frame tent means frame tent, additional items such as lights, sidewalls, draping, or additional tent accessories are addition fees. Set up is included with Tent, dance floors and Stage. The set up for additional equipment is available at addition fee.
DELIVERY:
1. A delivery charge is applied to every delivery request. Delivery Hours are Monday- Friday 9AM - 5PM. Sat 9AM – 3PM. Fee doubles after hours Delivery / pick up. For out of town delivery call office for an estimate. For Weekends with high volume of deliveries, deliver / pick up hours may exceed after hours due to unpredicted traffic, weather, ECT. We will notify customers if such delay occurs.
2. We cannot guarantee a specific delivery/pickup time. We require a minimum of 4 hour time frame to deliver. To find out when your order is scheduled for delivery/pick-up, please call the day before the delivery/pick-up date indicated on your contract.
3. If you are scheduled for a Friday delivery, we may call you at the beginning of the week and move the delivery day up a day or two according to our workload and weather conditions.
4. Pickups that are scheduled for Monday may be pushed back to a later day due to inclement weather or other scheduling issues. Your flexibility is greatly appreciated by our staff. Keep in mind that the safety of all equipment is the customer’s responsibility from the time of delivery to the time of pickup
5. If items must be transported to specific area, i.e. (inside building, upstairs, elevators, etc.), customer is to pay additional minimum fee.
If a Tent is being set up, we do require Client to be home for set up otherwise, Client must mark indicating where tent will be set up. Otherwise Set up will be determined by Crew members. Additional fees will apply for relocation of tent, Labor, & Set up fee.
WEATHER:
Client understands that tents are temporary structures designed to provide limited protection from weather conditions: however, there may be situations that become unsafe such as high winds or lightning. Evacuation of tents is recommended in these or other unsafe conditions. Tents are not guaranteed to be completely waterproof.
TENT INSTALLATION:
All tents we install will be staked into the ground or tie down with water weights. It is the customer’s responsibility to know what is underground before we arrive. We are not responsible for any underground utilities, sprinkler systems, septic systems, electrical, rocks, etc. Keep in mind that overhead clearance (i.e. electrical wires, tree branches, etc.) is also necessary. Permits for tents are customer’s responsibility. If severe weather is predicted, we reserve the right to refuse to install a frame tent.
Please note that in the event of an emergency or problems with equipment, it is up to the customer
to contact South Party Rental at (561)791-2950 immediately in order to expedite the problem. If Customer fails to contact South Party Rental, the Lessor is not responsible for any Refunds.
South Party Rental is under no contract with the Client other than what is stated above. We hold the right to refuse, deny and/or hold any order regardless of length of the business relationship. We hold the right to refuse deny and/or hold any order due to lack of payment for original invoices, late fees, replacement fees and/or any other fee outlined above. South Party Rental is not responsible for the fees charged by any other company for your rental needs due to South Party Rental, refusing, denying and/or holding orders.
Customer agrees to assume the risk of and hold South Party Rental harmless for, property damage and personal injuries caused by the equipment and/or arising out of customer negligence.
